State Representative Larry Womble, D-Forsyth, Still Unable to Speak Following Accident
...
or go backWXII-12 reported that State Representative Larry Womble, D-Forsyth is still unable to speak following the
injuries sustained in an accident in
Winston-Salem that killed the other driver, 54-year-old David Carmichael.
Winston-Salem police said that Carmichael’s blood alcohol was .29 at the time of the accident, three times greater than the legal limit. Representative Womble had no alcohol in his system, according to the tests. The District
Attorney now has the results of the toxicology tests.
Rep. Womble was upgraded from critical to serious condition in the ICU at Wake Forest Baptist Medical Center on New Year’s Eve. The accident happened at the beginning of December 2011. A spokesperson for the Representative indicated that Womble is alert and responsive, but still unable to speak as a result of his
injuries, communicating only by shaking or nodding his head.
Details regarding the cause of the accident are still under investigation, but it would appear that alcohol was definitely a contributing factor. Mr. Carmichael, who leaves behind a son, a grandson, and a granddaughter, most likely was at fault in the accident due to his impaired condition. However, David Carmichael may not have been the only responsible party.
Unfortunately, Representative Womble still faces many challenges, and he has a long road of recovery ahead of him. Thankfully, however, he has already made enormous strides in recovering from his
injuries. Already, the medical bills facing the Representative are astronomical. They will only increase as he continues to receive medical care, treatments, and therapies. In addition, it is unknown whether he will be able to return to his position as a State Representative or if he will even be able to work at all.
Once he is able, it would behoove Representative Womble to consult with a
personal injuries attorney in Winston-Salem. A
personal injuries attorney can help to determine Mr. Carmichael’s whereabouts leading up to the accident. Was he at a party? Had he been in a bar or a restaurant? These are questions that will need to be answered to determine who else may be liable for Rep. Womble’s
injuries.
It may be that David Carmichael’s allegedly inebriated state was all of his own doing and that he was the only one accountable for the accident. However, if there is any other sort of liability, Womble’s
Winston-Salem personal injuries attorney can help to make sure that Representative Womble gets the justice that he deserves and that all responsible parties are held accountable for this tragic accident. Ultimately, Representative Womble’s
personal injuries attorney in Winston-Salem will help him to discern whether he does or does not have a
personal injuries case.
